A judge from Maricopa County (Ariz.) Superior Court has ruled the Glendale City Council's approval of a Phoenix Coyotes deal should stand.
Judge Dean Fink's decision comes almost two weeks after the Phoenix-based Goldwater Institute tried to make a case that the vote to approve an arena lease agreement with Greg Jamison, the potential new owner of the Coyotes, should be struck down because of a lack of necessary votes to allow the deal to immediately go into effect and the fact that an arena operations contract was never put up for a competitive bid.
"It's another positive step forward in the process," NHL Deputy Commissioner Bill Daly said. "Hopefully, we are closing in on a finish line, although no specific timeline has been established."
On June 8, the Glendale City Council passed a 20-year, $324 million lease agreement with Jamison. The Goldwater Institute filed suit the following week.
In his ruling Thursday, the judge said Goldwater's arguments were not strong enough to overturn the vote. According to court documents, Fink rejected Goldwater's assertion that the city should have allowed multiple companies to submit bids for arena operations rather than to simply accept Jamison's offer.
